Terms of Use

By downloading, installing, accessing or using the EagerWorkouts mobile application, or by using this website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use EagerWorkouts.

EagerWorkouts is provided by The Eagerman’s Limited, a private limited company registered in England and Wales (company number 16237368), with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. In these Terms, “EagerWorkouts”, “we”, “us” and “our” refer to The Eagerman’s Limited.

You must be at least 16 years old to use EagerWorkouts. By using the app or this website, you confirm that you meet this requirement.

EagerWorkouts is a fitness and workout application. Depending on the version of the app you’re using, it currently provides:

• recommended workouts;
• the ability to create your own workout by selecting target areas and quick splits;
• a workout review step before you begin;
• exercise information, including demonstration media and instructions;
• a guided Active Workout mode that takes you through your exercises and sets;
• workout completion logging and workout history;
• a Recovery section showing recent training information and a daily subjective check-in; and
• optional notifications and reminders.

Features may be added, changed, improved or removed over time as the app develops; see section 11 for more on availability and changes.

The workouts, exercise information and other content in EagerWorkouts are provided for general fitness and informational purposes only. Nothing in the app or on this website is, or is intended to be, medical advice, diagnosis or treatment, and EagerWorkouts does not assess whether you are medically fit to exercise. Recovery, in particular, reflects information you choose to record about how you feel; it is not a medical readiness score and should not be treated as one.

If you have a medical condition, injury, or any concern about whether exercise is appropriate for you, you should seek advice from an appropriately qualified professional before starting or changing your exercise routine.

You are responsible for deciding which exercises, workouts, resistance and intensity are appropriate for you, and for performing them safely and within your own ability. You should stop exercising and seek appropriate medical assistance if you experience pain, dizziness, chest discomfort, shortness of breath, or any other concerning symptom while training.

EagerWorkouts does not guarantee any particular fitness result, and individual results will vary depending on many factors outside our control, including your own effort, technique, health and consistency.

EagerWorkouts does not currently offer subscriptions or process any in-app payments, and the features described in these Terms are currently provided without charge. This may change in the future; if it does, we will update these Terms and provide appropriate notice before any charge applies to you.

EagerWorkouts, including its app, website, branding, exercise media, and other content, is owned by or licensed to The Eagerman’s Limited and is protected by copyright, trade mark and other intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the app and this website for your own personal use, in accordance with these Terms.

When using EagerWorkouts, you agree not to:

• use the app or website for any unlawful purpose, or in a way that could damage, disable or impair them;
• attempt to gain unauthorised access to any part of the app, website, or the infrastructure behind them;
• copy, scrape, extract, reverse engineer or redistribute the app’s or website’s content, code or exercise media, in whole or in part, except as permitted by applicable law; or
• use automated tools to access or extract content from the app or website beyond ordinary personal use.

EagerWorkouts relies on third-party infrastructure and service providers, including Cloudflare, to deliver certain features such as exercise media. We are not responsible for the availability of infrastructure operated by third parties, though we choose providers we consider reputable for the purpose.

We aim to keep EagerWorkouts available and working well, but we do not guarantee that the app or website will always be available, uninterrupted, or error-free. We may update, change, suspend or discontinue features of EagerWorkouts, or the app or website as a whole, at any time, including for maintenance or improvement.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited under the law of England and Wales.

Subject to that, EagerWorkouts is provided on an “as is” and “as available” basis. To the extent permitted by law, we do not accept liability for indirect or consequential losses arising from your use of EagerWorkouts. Nothing in these Terms is intended to affect your statutory rights.

We may suspend or restrict your access to EagerWorkouts if we reasonably believe you have breached these Terms, or used the app or website in a way that could cause harm to us, other users, or third parties. As EagerWorkouts does not currently require an account, this may take the form of restricting access to the app or website rather than closing an account.

We may update these Terms from time to time, for example as EagerWorkouts’ features change. We will update the “Last updated” date at the top of this page when we do. Continuing to use EagerWorkouts after an update means you accept the revised Terms.

These Terms are governed by the laws of England and Wales. If you are a consumer, you may also have mandatory legal rights and protections under the law of the country in which you live, and nothing in these Terms is intended to remove or limit any right that cannot lawfully be excluded. Any dispute arising from these Terms may be brought before the courts of England and Wales, without this being read as excluding mandatory rights you may have to bring proceedings in your own country of residence where applicable law gives you that right.
