Terms of Use

By downloading, installing, accessing or using the EagerWorkouts mobile application, or by using this website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use EagerWorkouts.

EagerWorkouts is provided by The Eagerman’s Limited, a private limited company registered in England and Wales (company number 16237368), with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. In these Terms, “EagerWorkouts”, “we”, “us” and “our” refer to The Eagerman’s Limited.

You must be at least 16 years old to use EagerWorkouts. By using the app or this website, you confirm that you meet this requirement.

EagerWorkouts is a fitness and workout application. It currently provides:

• recommended workouts based on your recent training;
• a Workout Builder that creates a workout from your goal, experience level, location, target areas or split, duration and rest time;
• the ability to review, adjust and save workouts before you start;
• exercise information, including demonstration media and instructions;
• a guided Active Workout mode that takes you through your exercises and sets, with set logging and rest timing;
• workout history, progress information, weekly goals, streaks and a training calendar;
• a Recovery section showing recent training information and a daily subjective check-in;
• optional reminders; and
• an optional paid subscription, EagerWorkouts Pro, described in section 7.

We develop EagerWorkouts over time. Section 13 explains how we may change it, and the protections that apply to features included in EagerWorkouts Pro.

The workouts, exercise information and other content in EagerWorkouts are provided for general fitness and informational purposes only. Nothing in the app or on this website is, or is intended to be, medical advice, diagnosis or treatment, and EagerWorkouts does not assess whether you are medically fit to exercise. Recovery, in particular, reflects information you choose to record about how you feel; it is not a medical readiness score and should not be treated as one.

If you have a medical condition, injury, or any concern about whether exercise is appropriate for you, you should seek advice from an appropriately qualified professional before starting or changing your exercise routine.

You are responsible for deciding which exercises, workouts, resistance and intensity are appropriate for you, and for performing them safely and within your own ability. You should stop exercising and seek appropriate medical assistance if you experience pain, dizziness, chest discomfort, shortness of breath, or any other concerning symptom while training.

EagerWorkouts does not guarantee any particular fitness result, and individual results will vary depending on many factors outside our control, including your own effort, technique, health and consistency.

7.1 What is free and what needs a subscription. You can complete one workout in EagerWorkouts without a subscription. To start further workouts, you need EagerWorkouts Pro, an optional subscription that gives you unlimited workouts. Without a subscription you can continue to use the app’s other features, such as building, reviewing and saving workouts, viewing your progress and history, and using Recovery.

7.2 Plans and where they are sold. EagerWorkouts Pro is available as a monthly subscription or an annual subscription. EagerWorkouts is available on iPhone through the Apple App Store and on Android through Google Play. EagerWorkouts Pro is sold, billed and managed through the in-app payment system of the store you download EagerWorkouts from: Apple’s in-app purchase system on iPhone, or Google Play Billing on Android.

7.3 What you see before you subscribe. Before you subscribe, the app and your app store show you the plan you are choosing, its price including any applicable taxes, how often you will be billed, any free trial or introductory offer that applies to you, and the renewal terms. Prices can vary by country and currency. The price and terms shown when you subscribe are the ones that apply at that time. Any later change to the price of your subscription is made only as described in section 7.6.

7.4 Free trials. Eligible new subscribers may receive a seven-day free trial with either the monthly or the annual plan. Whether you are eligible is decided by Apple or Google under their own rules; for example, a trial is not usually available if you have already used a free trial or another introductory offer for EagerWorkouts Pro on your account. If a trial is available to you, it is shown before you confirm. Unless you cancel before the trial ends, your subscription will continue automatically as a paid subscription at the end of the trial, and you will be charged the price shown for the plan you chose. You can check when your trial ends in your app store’s subscription settings, and you should cancel in good time before then if you don’t want to continue — for example, Apple advises cancelling at least 24 hours before an App Store trial ends. If you cancel during a trial, when your access ends is determined by your app store’s rules.

7.5 Automatic renewal. Your subscription renews automatically at the end of each billing period — each month or each year, depending on your plan — and your app store will charge you for the next period unless you cancel before your renewal date.

7.6 Price changes. If we change the price of EagerWorkouts Pro for existing subscribers, the change will be made through your app store and will follow that store’s process. We or your app store will tell you about a price increase before it takes effect, and you will be able to cancel before you are charged the new price. Where the law or your app store requires your agreement to a price increase, your subscription will not renew at the new price unless you give that agreement. A price change never affects a billing period you have already paid for.

7.7 Cancelling. You can cancel at any time in your app store’s subscription settings:

• on iPhone, in Settings > [your name] > Subscriptions (see Apple’s guidance at support.apple.com/118428); or
• on Android, in the Google Play Store app under Payments & subscriptions > Subscriptions (see Google’s guidance at support.google.com/googleplay/answer/7018481).

You can also reach your subscription from the app: open the Progress tab, then your Profile, then Settings, and choose EagerWorkouts Pro. To avoid an unwanted renewal, cancel before your next billing date, and check your subscription settings for the renewal and cancellation details that apply to you. When you cancel a paid subscription, it will not renew. You will normally keep access to EagerWorkouts Pro until the end of the billing period you have already paid for, unless your app store’s rules provide otherwise — for example, if a payment is refunded or a purchase is revoked by Apple or Google. This does not affect your rights under consumer law.

7.8 Refunds. Cancelling stops future payments but does not by itself refund payments already made. Refunds are dealt with in section 9, and nothing in this section affects your rights under consumer law.

Deleting EagerWorkouts’ app data, clearing its storage, or uninstalling the app from your device does not cancel an active subscription or stop future billing. Your subscription is managed by the app store you purchased it through (Google Play or the Apple App Store), independently of the app and its locally stored data, so you must cancel it directly through that app store if you no longer want to be charged.

Subscription payments are processed by the app store you purchased through, and refund requests are handled by that platform in accordance with its own refund policies:

• for Google Play purchases, see Google’s refund guidance at support.google.com/googleplay/answer/15574897; and
• for Apple App Store purchases, see Apple’s refund guidance at support.apple.com/118223.

We are not able to issue refunds directly through the app, because payments are taken by Apple or Google. This does not affect your rights as a consumer. Nothing in these Terms limits any right you have under applicable consumer law — including, in the UK, your rights under the Consumer Rights Act 2015 if digital content is faulty or not as described — and those rights may apply independently of either app store’s own refund policies. If you’re not sure where to request a refund, contact us through our Support page or at support@eagerworkouts.com and we’ll help.

EagerWorkouts, including its app, website, branding, exercise media, and other content, is owned by or licensed to The Eagerman’s Limited and is protected by copyright, trade mark and other intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the app and this website for your own personal use, in accordance with these Terms.

When using EagerWorkouts, you agree not to:

• use the app or website for any unlawful purpose, or in a way that could damage, disable or impair them;
• attempt to gain unauthorised access to any part of the app, website, or the infrastructure behind them;
• copy, scrape, extract, reverse engineer or redistribute the app’s or website’s content, code or exercise media, in whole or in part, except as permitted by applicable law; or
• use automated tools to access or extract content from the app or website beyond ordinary personal use.

EagerWorkouts relies on third-party infrastructure and service providers — including Cloudflare for exercise media, app update information and hosting this website, Google Play Billing and the Apple App Store for subscription purchases, and RevenueCat for subscription management — to deliver certain features of the app. We choose providers we consider reputable for the purpose. Temporary interruptions caused by these providers are dealt with in section 13.3, and section 14 sets out our responsibility to you.

13.1 Availability. We aim to keep EagerWorkouts and this website available and working well. Because they depend on internet connections, devices and third-party infrastructure, we cannot promise that they will always be available, uninterrupted or error-free.

13.2 Routine improvements and maintenance. We may update and improve EagerWorkouts from time to time — for example, to fix errors, improve performance, refine the design or add new features. Routine updates will not materially reduce the features included in EagerWorkouts Pro during a period you have paid for; any such reduction is dealt with under section 13.5. Some updates may need you to install the latest version of the app for it to keep working correctly.

13.3 Temporary interruptions. We may need to suspend all or part of EagerWorkouts or this website temporarily — for example, for maintenance, to fix a problem, or because a service we rely on is unavailable. We will try to keep interruptions as short as reasonably possible and, where we can, to carry out planned maintenance at times that cause least disruption.

13.4 Changes for security, compatibility or legal reasons. We may change, restrict or remove a feature where this is reasonably necessary to protect the security of EagerWorkouts or its users, to keep EagerWorkouts working with current versions of iOS, Android or third-party services it relies on, or to comply with the law or with Apple’s or Google’s requirements. If such a change materially reduces what EagerWorkouts Pro includes, section 13.5 also applies.

13.5 Material reductions to EagerWorkouts Pro. If we plan to remove or materially reduce a feature included in EagerWorkouts Pro, or to stop offering EagerWorkouts Pro, we will publish a notice on this website before the change takes effect, where we reasonably can, explaining the change and what it means for you. You can cancel your subscription before the change takes effect (see section 7.7), but cancelling is not necessarily your only option: if what you have paid for is reduced or is no longer as described, consumer law may also entitle you to other remedies, such as a price reduction or a refund, depending on the circumstances. Nothing in this section limits those rights. Because payments are taken by Apple or Google, a refund may need to be requested from them. If you have questions about a change, contact us at support@eagerworkouts.com and we will explain the options available to you.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited under the law of England and Wales.

To the extent permitted by law, we do not accept liability for indirect or consequential losses arising from your use of EagerWorkouts. Nothing in these Terms is intended to affect your statutory rights.

We may suspend or restrict your access to EagerWorkouts if we reasonably believe you have breached these Terms, or used the app or website in a way that could cause harm to us, other users, or third parties. As EagerWorkouts does not currently require an account, this may take the form of restricting access to the app or website rather than closing an account. Restricting your access in this way does not automatically cancel any active subscription — you may still need to cancel it separately through the app store you purchased it from (Google Play or the Apple App Store) to stop being charged.

16.1 Publishing changes. The current version of these Terms is always published on this page, with the date it was last updated.

16.2 Minor changes. We may make changes that do not adversely affect you — for example, to describe new features, reflect changes to our app or service providers, make the Terms clearer, or correct errors. These take effect when we publish them on this page.

16.3 Material changes. If we make a change that could adversely affect you — for example, to what EagerWorkouts Pro includes, or to how your subscription works — we will publish the revised Terms on this page, together with a notice on this website explaining the change and what it means for you, giving reasonable notice before the change takes effect. A shorter period may apply only where a change is needed urgently for legal, regulatory or security reasons. Publishing a change on this website does not replace any additional notice, consent or agreement required by law or by your app store’s rules; where such a requirement applies, we will not apply the change to you unless it has been met. Because EagerWorkouts does not have accounts or collect your contact details, we are not currently able to notify you individually.

16.4 Your choices. If you do not want to accept a material change, you can cancel your subscription before the change takes effect (see section 7.7), and you will not be charged for any renewal after your cancellation takes effect.

16.5 Changes that need your agreement. Where the law or your app store requires your agreement to a change — for example, certain price increases (see section 7.6) — we will apply the change to you only if you give that agreement, using the method your app store provides. We will not treat your continued use of EagerWorkouts alone as agreement to such a change.

These Terms are governed by the laws of England and Wales. If you are a consumer, you may also have mandatory legal rights and protections under the law of the country in which you live, and nothing in these Terms is intended to remove or limit any right that cannot lawfully be excluded. Any dispute arising from these Terms may be brought before the courts of England and Wales, without this being read as excluding mandatory rights you may have to bring proceedings in your own country of residence where applicable law gives you that right.
